As set out in our statement dated 11 December 2019, Elite was placed into administration by the Supreme Court of Gibraltar with Edgar Lavarello and Dan Schwarzmann of PwC appointed as joint administrators.
With effect from (and including) 15 September 2020, the joint administrators have disclaimed all French construction policies provided by Elite including all policies issued to homeowners in respect of Dommages-ouvrage (DO) insurance, to contractors and other parties in respect of Responsabilité Civile Décennale (RCD) insurance placed by Securities & Financial Solutions Europe S.A. (in Liquidation) (“SFS”), Proficia Solutions Limited (in Administration) previously European Insurance Services Limited (“EISL”), Pro-First, UBI LTD and SEGAP, and also cover under Responsabilité Civile Professionnelle (RCP), Constructeur non réalisateur (CNR), Toute Risque Chantier (TRC) and Garantie Financière d'Achèvement (GFA) policies.
As a result of the disclaimer, all of the French construction policies are terminated with effect from (and including) 15 September 2020. Under Gibraltar’s Insolvency Act, policyholders, and any other person whose rights are affected by the disclaimer, can submit a claim in Elite’s administration for any loss or damage they suffered as a consequence of the disclaimer.
